Billings Attorney Gene Jarussi’s case against Yellowstone County regarding the privatization of management of Metra Park is awaiting a decision by Judge Rod Souza of the 13th District Court of Yellowstone County as to whether the case will be dismissed. Oak View Group (OVG), a private management company, was also named as a defendant in the case.
Just prior to press time last week, the County’s counsel, Jeana R. Lervick with the County Attorney’s office, filed a motion asking the court to dismiss the case because the County Commissioners were dropping the RFP process that Jarussi was contesting, which she said rendered the case “moot.”
The County adamantly denied that it did anything wrong, said Lervick, but in the “best interests of the community” they were ending the RFP process. Lervick filed a motion asking the court to dismiss the case because there was no longer a case – “There is no process for the Court to stop. There is no relief for the Court to grant.”
