No Opposition to House Bill

Easing Access to Public Defenders

by Michael J. Marino

Testimony was given Monday, Jan. 9 to the House Judiciary Committee regarding House Bill (HB) 111, which would make it easier for people to get a public defender when involved in legal matters in state courts. In some cases, the financial eligibility forms would be cut out and the state would immediately assign a public defender.

HB 111 Sponsor, Jodee Etchart (R-Billings), told committee members the purpose of the proposed statute is to prevent people from showing up to court without proper representation or legal counsel. The bill is further designed to “better serve our citizens in time[s] of crisis.”

Brian Smith from the State Public Defender’s Office said if passed, the legislation would save the office about $20,000 per year.

The bill will now go on to a second reading on the floor of the house.
